Need Help With Contract Law Issues?
Contracts are the foundation on which most business relationships rest. The rights and obligations of each party to any project are typically defined and governed by written contracts. At Magaziner Law, P.A., we represent general contractors, tradespeople, construction managers, design professionals, material suppliers, and project owners in all manners of payment and contract disputes from inception to resolution.
Is It in the Contract?
The provisions and conditions within the contract will determine all aspects of the parties’ interactions and will dictate the scope of work and areas of operation, the limits or extent of oversite and control, the amount and timing of payments, standard operating procedure, changes and amendments to the materials or design, the conditions to determine performance and completion, the rights of indemnification, the recovery for breaches, the means of dispute resolution, and other rights and responsibilities.
The presence of poorly defined terms or other ambiguities can lead to misunderstandings and disputes, clouding the prospects for success on any project. A well-drafted contract that accurately encompasses the rights and responsibilities of the parties is essential.
Preventing Disputes Before They Develop
At Magaziner Law, P.A., we also recognize that an ounce of prevention is worth a pound of cure. That’s why we develop long-term relationships with our clients and are there to assist them before a problem can develop.
After all, it is far less expensive to avoid disputes than it is to resolve them. We will assist in drafting, revising, and negotiating construction contracts and subcontractor agreements as well as service agreements and joint enterprises to avoid the common pitfalls that lead to classic disputes.
We also will be there to help draft change orders and contract addendums, when the need arises, on large or sensitive issues to make sure that all parties are in agreement before projects stall, ensuring a smooth and uninterrupted construction schedule.
